Nintendo files 7 DMCA notices in one day, taking down 401 Switch emulator repos on GitHub

Published Updated 2 min read

Key points

  • On Aug 17, 2026, Nintendo filed seven anti-circumvention DMCA notices with GitHub. TorrentFreak said 400+ repos; its per-notice counts add up to 401.
  • The biggest notice hit suyu. The network had over 100 repos, so GitHub processed all of it: 311 repos.
  • The rest: Skyline (29), two Yuzu fork networks (14 and 8), Yuzu Early Access 4176 copies (21), MonoNX (17) and one lone Yuzu repo.
  • Nintendo's argument: Switch games are encrypted with prod.keys, and emulators necessarily use unauthorized copies of those keys.
  • Both precedents the notices cite (the Yuzu settlement and the EveryGameGuru default judgment) were never decided on the merits.

On August 17, 2026, Nintendo filed seven anti-circumvention DMCA notices with GitHub on the same day, hitting more than 400 Switch emulator repositories. TorrentFreak listed each notice's count, and they add up to 401. The biggest notice targeted suyu: its network was larger than 100 repos, so GitHub processed the whole thing and removed 311 at once.

How many repos each notice hit

The numbers below come from TorrentFreak's August 21 report. We checked the suyu row against the original GitHub notice, and it matches.

TorrentFreak's own headline says "400+" because three notices had no published network total, so those counts come from the repos named in each notice. The real number removed may differ slightly.

Nintendo's argument

All seven notices use the same wording. Switch games are protected with proprietary cryptographic keys (prod.keys), and the emulators "necessarily use unauthorized copies of these cryptographic keys" to decrypt games at runtime. Nintendo says that is circumvention under 17 U.S.C. 1201(a), and that distributing the emulators is trafficking in circumvention technology. The notices also say the reported repos "offer, link to, or otherwise provide access to" Switch emulators. In Nintendo's view, even linking to an emulator is in scope.

Every notice cites two precedents:

  • the 2024 consent judgment against Yuzu developer Tropic Haze ($2.4 million settlement);
  • the 2025 default judgment against streamer EveryGameGuru in Colorado ($17,500).

TorrentFreak points out that one was a settlement and the other a default judgment after the defendant stopped responding. In neither case did a court weigh the emulator circumvention question on the merits. At the takedown stage, Nintendo doesn't have to prove it.

Where it fits in 2026

  • Feb 12: one notice named 13 emulators, including Citron, Eden and Ryubing.
  • Mar 27: Eden's automated build repos and a batch of Citron and Sumi forks.
  • Jul 10: dozens of copies of Eden's website source, plus Ryubing-related repos.
  • Aug 17: these seven notices.
  • Early to mid September: suyu published v0.04, which it called its final public version, and archived the repo.

TorrentFreak's take: every emulator on this list "was already supposed to be gone". They came back through forks, mirrors and revivals, which put them back on Nintendo's radar. Removing repos is easy. Keeping the code offline is much harder.

What this means for players

This round mostly hit suyu's old repo network and copies of long-dead yuzu and Skyline. Actively developed Eden keeps its source on its own server, and Citron Neo wasn't on this list, so neither was affected. As official channels keep getting removed, impostor download sites have an easier time fooling people, so only trust official sites. See how to spot fake emulator sites. For emulators that are still maintained, read the best Switch emulator in 2026, and for the legal side, are Switch emulators legal.

FAQ

Where does the 401 figure come from?

TorrentFreak's headline says 400+, and its table lists each notice: suyu 311, Skyline 29, Yuzu forks 14 and 8, Yuzu Early Access 4176 copies 21, MonoNX 17, and one Yuzu repo. That adds up to 401. Four counts are GitHub's processed network totals; the other three are repos listed in the notices.

Were active emulators taken down?

Mostly no. The targets were GitHub copies and forks of projects that had already stopped or moved, such as suyu, Yuzu and Skyline. Eden keeps its source on its own server, and Citron Neo wasn't on this round's list.

What is Nintendo's legal argument?

The notices say Switch games are encrypted with prod.keys and that emulators necessarily use unauthorized copies of those keys to decrypt games, which violates the anti-circumvention rules in 17 U.S.C. 1201. Distributing such emulators counts as trafficking in circumvention technology.

What happened to suyu afterward?

In early September, suyu published v0.04, which it called its final public version, and then archived the repository. The project didn't connect this to the August takedown. Newer contributors have since picked up separate suyu branches.
